Privacy Policy
1. INTRODUCTION
This privacy policy (“Policy”) sets out the manner in which Perfios Software Solutions Private Limited, a private company having its registered office at 111, 1st Floor, A-Wing, Boomerang, Chandivali Road, Yadav Nagar, Chandivali, Powai, Mumbai, Maharashtra, India – 400072 (“Company”, “we”, “our”, “us”) collects, uses, maintains and shares information about You (“User” or “You” or “Your”) through online interfaces (e.g. – mobile applications, website) owned and controlled by us (collectively referred to herein as the “Company Systems”).
In the course of Your use or access of the Company Systems, the Company may collect distinct categories of information from You. This Policy endeavours to inform You of the types of information that may be collected, and the manner in which such information is collected, used, processed, disclosed and maintained. This Policy must be read in conjunction with the other agreements You enter into with the Company and the Terms of Use as published by the Company on the Company’s website.
Please read and understand the Policy carefully. Your use or access of the Company Systems shall constitute Your agreement to this Policy. If You do not agree with our policies and our practices as described in this Policy, Your choice is to not use the Company Systems.
By accepting the Policy, You expressly consent to the Company’s use and disclosure of your personal information and sensitive personal information in accordance with this Policy.
2. APPLICABILITY OF THE POLICY
2.1) This Policy shall apply to all information the Company collects through the Company Systems and/or in the course of Your use of the Company Systems.
2.2) This Policy does not apply to, nor does the Company take any responsibility for, any information that is collected by any third party either using Company Systems or through any links on the Company Systems or through any of the advertisements or through BOTS.
3. INFORMATION WE COLLECTION
The following types of information shall be collected by the Company:
3.1) Information You Share
(a) We will only collect information which You share with us. You can choose what information you want to share with us. We will collect Your information only if you choose to share it through the Company Systems.
(b) We will collect the following information about You or related to Your use of the Company’s Systems:
(i) any personal information or sensitive personal information (as defined by applicable laws of India) that You may submit or may be required to submit for registration and continued use of the Company Systems or to evaluate any of the Company Systems;
(ii) any personal information or sensitive personal information of any other individual that You provide in the course of using the Company Systems; and
(iii) any other information You may choose to further provide us, without limitation, any information to update your account and profile, if required, to fill out any forms, provide your feedback to surveys, or to use any features of Company Systems.
3.1.1) Please do not include any personal information, or sensitive personal information unless specifically requested by the Company as part of the registration or other applicable processes. If the Company determines that any information You have provided or uploaded violates the terms of this Policy, the Company has the right, in its absolute discretion, to delete or destroy such information without incurring any liability to You.
3.1.2) We may collect information volunteered by users (such as optional survey/poll information and/or site registration). These surveys may ask You for contact information and demographic information and other information specified in Section 3 herein.
3.1.3) You have the right to (i) choose what personal information or sensitive personal information You provide to the Company and (ii) restrict the disclosure of Your personal information to third parties; however, please note that this may affect Your seamless access to the Company Systems. Further, You acknowledge that if You choose not to provide all of the mandatory information and data that is requested of You, the Company may not be able to provide access to the Company Systems to You.
3.2) Default Collection of Information
(a) The Company shall collect the information that are provided by You as direct user input in the course of Your use of the Company Systems.
(b) The Company shall also collect information through automatic tracking of Your use of the Company Systems, irrespective of whether You have created an account with us or not. Such information may include, without limitation, Your interactions with the Company Systems, such as the viewed pages, nature of search, experience on use of the Company Systems, IP addresses, details of Your computer system, device id, browser, location, connections, or any information that the Company may collect through the use of cookies and other tracking technologies. The collection of data may in most cases be automatic.
(c) “Cookies” are files that would be placed in Your Computer System’s or device’s hard drive and browser and are intended to improve Your experience of use of the Company Systems, by enabling us to track Your usage of the Company Systems and preference, a history of the pages You view, time and date, advertisements and links that You visit and other user information. You may decline these cookies by changing Your settings, if permitted. However, do note that doing so may impact certain features of the Company Systems. A persistent cookie remains after You close Your browser and may be used by Your browser on subsequent visits to the Company’s Systems. Persistent cookies can be removed using tools available in some browsers. Please review Your web browser “Help” file to learn the best way to modify Your cookie settings. You can however, opt-out of such collection and use of information for reasons like that of ad targeting.
3.3) Information from Other Sources
(a) We may also periodically use Your information received from third-party sources and combine it with Your account information. For example: if You access or login to our Company Systems via a third-party source like the portal of a bank or any other financial institution, we may receive Your registration information, and combine that with information we collect through our Company Systems or add it to Your account information on our Company Systems.
4. Use of your information
4.1) The information that we collect through the Company Systems, including Your personal information and sensitive personal information, as applicable, will be used for these following purposes of:
(a) operating the Company Systems;
(b) facilitating Your Use of the Company Systems by, including without limitation, enabling You to access the Company Systems;
(c) providing You with promotional mails/posts, advertising, and other information of interest to You based on your communication preferences;
(d) using such information for improving, optimizing, developing and administering the Company Systems results and experience;
(e) enabling the functionalities of the Company Systems;
(f) analysis of the usage pattern of the Company Systems, by way of conducting such market research and surveys
(g) resolving disputes, troubleshooting any other problems,
(h) risk assessment and conducting investigations;
(i) prevention of any kind of abuse such as fraud, spam, security breach, and for detection and prevention of any proscribed or illegal activities; and
(j) any other reasons in connection with the provision of the Company Systems to You, enforce our Terms and Conditions, payment terms, compliance with legal requirements and other policies.
4.2) You agree that the Company may use Your personal information to contact You and deliver information, to render use of the Company Systems sought by You from the Company and to deliver administrative notices and any other communication relevant to Your use of the Company Systems.
5. DISCLOSURE OF YOUR INFORMATION
5.1) General: The information You provide on the Company Systems may be disclosed by the Company to its employees, agents, representatives, consultants, subsidiaries, affiliates and third-party providers, including without limitation, third parties who require the information for the purposes of operating and maintaining the Company Systems.
5.2) Disclosure Upon Your Consent: Except as otherwise provided herein, no personal information or sensitive personal information will be disclosed or shared with any third-party without Your express consent.The Company will not publish, sell or rent Your personal information to third parties for their marketing purposes without Your explicit consent.
5.3) Disclosure Under Applicable Laws: The Company will comply with requests and directions of all governmental, law enforcement or regulatory authorities, which it believes in good faith to be in accordance with any applicable law. Such compliance may include disclosing to the governmental, law enforcement or regulatory authorities’ information submitted by You or collected in relation to Your use of the Company Systems including any personal information and/or sensitive personal information. By using the Company Systems, You consent to the Company’s disclosure of information as set out in this Section 4 herein above, to governmental, law enforcement or regulatory authorities.
5.4) Disclosure to Affiliates: The Company may, as required and for the purposes of providing access to the Company Systems, share Your information within our affiliates, subsidiaries or other group companies. You hereby, authorize us to share, store, transfer, and process Your information in India and other countries as necessary and hence by using the Company Systems, You provide explicit consent for such transfer of Your information to these countries.
5.5) Events of Reorganization: In any given instance, if the Company undergoes any events of reorganization, merger, acquisition, insolvency, or bankruptcy, the Company may sell, transfer or share some or all of our assets, including your information, subject to notification to You pertaining to transfer of Your information.
5.6) Anonymized Information: The Company shall have the right to use Your information that is derived from the operations and use of the Company Systems, in an aggregated, anonymized, and statistical manner (“Anonymized Aggregated Data”). Nothing herein shall be construed as prohibiting the Company from utilizing the Anonymized Aggregated Data for the purposes of improving or developing the Company Systems. However, the Company shall not share with any third party any information that reveals Your identity.
5.7) Right to be forgotten: You may ask the Company to delete Your information but please note this deletion will affect Your use of the Company Systems.
6. CONNECTION WITH THIRD PARTY SOCIAL NETWORKS
6.1) In the event You visit the Company Systems from any websites or portals of third parties such as banks or financial institutions on iOS or Android (as the case may be), You will have an option to return to such websites or portals by pressing the system back button or such other back button.
6.2) Certain features or parts of Company Systems may use location search engines like Google Maps services that are subject to respective terms of use and the privacy policy of such location search engines.
7. DATA SECURITY
7.1) The information that You provide, subject to disclosure in accordance with this Policy, shall be maintained in a safe and secure manner. Your information shall be protected, to a commercially reasonable extent, against unauthorized access, use, or disclosure. The Company’s databases and information are stored on secure servers with appropriate firewalls.
7.2) As a user of the Company Systems, You have the responsibility to ensure data security. You must not disclose to any person the authentication parameters that are assigned to You including Your username or password for Your use of the Company Systems. You acknowledge that You will be solely responsible for all acts committed by use of Your username /other authentication parameters.
7.3) Given the nature of internet transactions, the Company does not take any responsibility for the transmission of information collected from You or are generated by Your use of the Company Systems. Any transmission of such information over the internet is done at Your sole risk. The Company does not take any responsibility for You or any third party circumventing the privacy settings or security measures contained on the Company Systems.
7.4) Notwithstanding anything to the contrary, while the Company will use all reasonable efforts to ensure that any information collected from You or are generated by Your use of the Company Systems is safe and secure, it offers no representation, warranties or other assurances that the security measures are adequate, safe, fool proof or impenetrable.
8. INTEGRATION WITH THIRD PARTY WEBSITE
8.1) Links to external, or third-party websites, may be provided solely for Your convenience. Such links from us to an external website does not imply or mean that the Company endorses or accepts any responsibility for the content or the use of such website. The Company does not give any representation regarding the quality, safety, suitability, or reliability of any external websites or any of the content or materials contained in them. It is important for You to take necessary precautions, especially to ensure appropriate safety from viruses, worms, Trojan horses and other potentially destructive items.
8.2) When visiting external websites, users should review those websites’ privacy policies and other terms of use to learn more about, what, why and how they collect and use any personally identifiable information.
8.3) Hyperlinks and hypertext links are provided on the Company Systems to promote easy access to the variety of information provided. We accept no liability, whatsoever, arising out of the use of such links.9. ACCESSING AND UPDATING YOUR INFORMATION
9.1) You can change, alter or otherwise modify or update the information submitted by You at any time by accessing the Company Systems and authenticating Yourself by using Your registered username or accessing Your user account, as applicable.
9.2) You may also change and/or delete any of the information You have submitted. The Company reserves the rights to retain any information regarding Your usage of the Company Systems and You are not entitled to require the Company to delete the same.
9.3) The Company at its sole discretion may permit or deny the change of any information if it reasonably believes that the same is required to observe its obligations under applicable laws.
9. ACCESSING AND UPDATING YOUR INFORMATION
9.1) You can change, alter or otherwise modify or update the information submitted by You at any time by accessing the Company Systems and authenticating Yourself by using Your registered username or accessing Your user account, as applicable.
9.2) You may also change and/or delete any of the information You have submitted. The Company reserves the rights to retain any information regarding Your usage of the Company Systems and You are not entitled to require the Company to delete the same.
9.3) The Company at its sole discretion may permit or deny the change of any information if it reasonably believes that the same is required to observe its obligations under applicable laws.
10. AGE RESTRICTIONS
The Company Systems are only intended for users who are of 18 years of age or older, unless represented by a parent or legal guardian. If You are not of the requisite age You must not provide any information to the Company either directly or by way of usage of the Company Systems. If the Company determines that it is in possession of any information belonging to an individual below 18 years of age which is submitted, collected or generated in breach of the terms of this Policy, it will delete the same without any notice to the individual to whom such information belongs to.
11. AMENDMENTS TO THE PRIVACY POLICY
We may update this Policy at our sole discretion and any changes to the Policy shall be effective on the date of updating this revised Policy to the Company Systems. We recommend that you periodically visit our Company Systems to review any changes to this Policy.
12. GRIEVANCE REDRESSAL
If You have any issue or grievance with respect to our Policy or with the manner in which we collect or store Your information, or in any respect related to Your personal information provided to us, please contact the Grievance Redressal Officer, Mr. Mohit Srivastava at grievances@perfios.com. We will do everything we reasonably can to ensure that Your grievance is attended to and addressed within a period of 15 days from the date of receipt of Your grievance.
